Regulatory framework
In Belgium, disclosing financial links has been a statutory duty since the Sunshine Act (Law of December 18, 2016, enacted via the RD of June 14, 2017). This mandate covers both the pharmaceutical and medical device industries.
All information is compiled and made public through Betransparent.be, the central transparency portal managed by Mdeon.
Who is subject to disclosure?
- Healthcare Professionals (HCPs)
- Healthcare Organizations/institutions (HCOs)
- Patient Organizations (POs)
What information is published?
On a nominative basis:
- Healthcare Professionals (HCPs)
- Financial support for attending scientific gatherings, including registration, travel, and lodging
- Remuneration for consultancy work and other expert services
- Healthcare Organizations (HCOs)
- Backing for scientific events and any sponsorship deals through the entity or appointed third parties
- Service fees for consultancy or other professional duties
- Grants and donations intended to support the health sector
- Patient Organizations (POs)
- Service fees for consultancy or other professional duties
- Financial or material contributions to assist the organization
On an aggregate basis:
Values transferred in the context of scientific R&D are disclosed collectively.
Publication & retention period
- Annually, by June 30 at the latest, covering the prior calendar year.
- Information remains publicly accessible for a period of 3 years.
